VACATION
RENTAL AGREEMENT 1.
DATE: The date of this agreement is: __________________. 2.
DEFINITIONS: WE, OUR and US mean the Owner. YOU and YOUR mean everyone listed as a tenant in Paragraph
11. UNIT means the place
you are renting from the Owner. 3.
YOU MAY NOT SUBLET, ETC.
You may not sublet, or let anyone else occupy the Unit or replace
you as the tenant, unless you have our written permission in advance.
You may use the unit only as a place to live.
You may not use it for any unlawful, improper, or offensive
purpose. 4.
WHEN AND HOW LONG YOU MAY OCCUPY: The
unit will be ready for you to move into on _______________ at
4:00pm. The term of
your occupancy will end on ________________ at 12:00 noon.
This means your occupancy will automatically end on that date at
that time. If you have our
permission in writing to do so, you may continue to rent.
In this case, your rent and all the other terms will remain the
same as in this Agreement, unless we tell you differently in writing.
NOTE: Your rental
term may be ended earlier, if you do not pay the rent and/or obey this
Agreement. If, after this
rental is terminated, you stay in the Unit without our written consent,
the rent will be double the rent under this agreement on a pro-rated
daily basis. 5.
RENT: The rent is $ __________
plus 4% general excise tax plus 7.25% transient accommodations tax
payable in advance. Total
for this rental is $ ___________.
To hold a reservation, a rental
deposit equaling at least one half of the total amount is required
within 10 days after booking.
The balance is due 10 days prior to
arrival. Payment must be made to Owner or deposited to bank account listed in Section 12 below.
6.
SECURITY DEPOSIT:
You must pay $300 in
advance as a security deposit prior to occupying the unit.
We will return your deposit, minus deductions, not later than 14
days after the termination of the rental agreement.
Deductions can be made to repair or replace any things that are
damaged or missing, to pay for any rent due, to replace any keys, locks
or gate openers, or to pay damages caused by your quitting the Unit
wrongfully. Any interest
earned on the security deposit shall be paid to the Owner. 7.
UTILITIES AND SERVICES:
We will provide and maintain the water, sewer, local telephone,
electricity and basic TV cable services.
8.
CONDITION OF THE UNIT AND THINGS IN IT:
a)
Before you move in, we will inspect and inventory the Unit and the things
in it. We will prepare an
INVENTORY AND CONDITION FORM, which will be posted on the kitchen
bulletin board in the Unit. You
should check the form carefully upon moving in and notify the Owner
within twenty-four hours of any discrepancies.
This form will be our agreement about (1) what the condition of
the Unit was, and (2) what things were in the Unit, and what their
condition was, when you moved in. b)
When you move out, you must take all your personal things with you.
You must also leave the Unit and the things in it in the same
condition they were in when you moved in, except for normal wear and
tear. If there is any
disagreement, the posted INVENTORY AND CONDITION FORM will be treated as
correct. 9.
KEYS AND GATE OPENER:
We are giving you two (2) entrance keys, two (2) deadbolt keys, one (1)
pool key, and one (1) gate opener for the Kuakini Hwy driveway entrance.
You may not have additional keys or gate openers made or locks
changed or added. You must
return all of these items when you move out, or pay to replace them. 10.
SPECIAL TERMS:
The Kona Pacific HOUSE
RULES as displayed on the kitchen bulletin board shall be considered a
part of this agreement. Particular
attention is directed to Section A-5 restricting disturbing noises, and
Section A-12 prohibiting the hanging of towels or other clothing on
lanai railings. No pets are
allowed. 11.
TENANT SIGNATURES:
By signing below, each
tenant agrees to pay the rent and obey this agreement. Each of you is liable for all of the rent and for
obeying all the rules.
